Kilmeade's stance followed on earlier segment where he challenged attorney Jay Sekulow, who recently joined President Donald Trump's legal team, on why he didn't advise the president to stop tweeting so much. As Salon's Heather Digby Parton points out, Sekulow's wife, brother, sons and sister-in-law "dominate the boards of both organizations" in an arrangement not dissimilar from how Trump ran his business and, to a lesser extent, the White House.

"There has been no notification from the special counsel's office that the president is under investigation", he said.

Wallace: You just said that he's being investigated. Speaking to a perplexed Jake Tapper on CNN, Sekulow said the president was responding to a Washington Post story and was not being investigated. Using this logic, Trump could fire the deputy attorney general and get rid of the special counsel tomorrow, and his view his actions would be justified under the Constitution.

"If in fact it's correct that the president is being investigated, he's being investigated for taking an action that an agency told him to take". "You just said, sir, you just said that he's being investigated". "That is protected under the constitution", Sekulow argued. Sekulow again repeated that he can not read minds. "I don't tell him what to write or not write", Sekulow said.

"The weirdest moment is when he's caught, and he does a reset and says, 'I want to make this crystal clear, '" Scarborough added, "and whenever anyone says that, (they mean), 'I want to make this as muddy and confusing as possible'".

"You just said two times that he's being investigated", Wallace said. "I don't think you should be rushing the stage, period, whether you agree or not".

"No, he's not being investigated", Sekulow interjected.
