Aadhaar-PAN linking must from July 1, govt notifies rules

According to the income tax laws, the government made the 12-digit biometric Aadhaar or the enrollment ID as necessary at the time applying for PAN card.

Already 2.07 crores tax payers linked Aadhar with PAN.

Arun Jaitley, who has to take the charges as Finance Minister through an amendment to Tax proposals in the Finance Bill for 2017-2018.

It also said from July 1, 2017 onwards every person eligible to obtain Aadhaar must quote their Aadhaar number or their Aadhaar enrolment ID number for filing of income tax returns as well as for applications for PAN.

The Supreme Court, earlier this month, had upheld the validity of an I-T Act provision making Aadhaar mandatory for allotment of PAN cards and ITR filing.

Those who only have PAN card and no Aadhaar have been given time till December 31 to get their Aadhaar card made.

The rules will come into force from July 1, 2017, the revenue department said while amending Rule 114 of the Income Tax Act, which deals in application for allotment of PAN. The government has also issued notification for changes in the income tax rules. It still kept the partial stay on the implementation.

The government has made it mandatory to link existing Aadhaar numbers with PAN of taxpayers with effect from July 1. The difference between the strength of Aadhaar and PAN holders is huge in India.

A new column for quoting of Aadhaar number has been provided for in Form 49A which is used for applying for PAN.

While opposing the government's move, the petitioners, including CPI leader Binoy Viswam, have contended before the bench that the Centre can not "belittle" the apex court's 2015 order holding the unique identification number as voluntary.

If a person does not link PAN and Aadhar as mandated by section 139AA then the person's PAN would become invalid.

The Supreme Court had observed that it was yet to be "tested" whether Aadhaar violated protection of life and personal liberty granted under Article 21 of the Constitution, which was pending hearing for an authoritative pronouncement by a five-judge Constitution Bench.

Significantly, there are more than 24.37 crores pancard in the country, and the aadhaar card of more than 113 crores has been made.
